ADC and the Australian Privacy Act

  • This Privacy Policy outlines how ADC and its related entities (“ADC” or “the ADC Group”) collect, hold, use, and disclose personal information. ADC adheres to the Australian Privacy Principles (APPs) as set out by the Office of the Australian Information Commissioner (OAIC). The APPs guide how ADC should handle personal information, including its collection, use, security, and disclosure, as well as how individuals can access their personal information records.
  • By using ADC’s websites, applications, and services, or by otherwise providing ADC with your information, you consent to ADC collecting, holding, using, and disclosing your personal information as described in this Privacy Policy. In this context, “personal information” has the meaning given in the Privacy Act 1988 (“the Privacy Act”) and includes information or an opinion, whether true or not, about an identified individual or an individual who is reasonably identifiable.

ADC Website

  • ADC does not collect identifiable personal information when you browse the ADC website to read or download information. However, visiting the ADC website may result in the recording of the following non-personal information for statistical purposes:
    • Your server address
    • Top-level domain name (e.g., .gov, .com, .edu, .org, .au, .nz)
    • Pages accessed and documents downloaded
    • Search terms used
    • Date and time of the visit
    • Previous site visited
    • Type of browser used
  • This data helps ADC manage the website efficiently and securely, including monitoring to prevent security breaches and to enhance the website to meet user needs. No attempt is made to identify visitors’ browsing activities, except in the unlikely event of a criminal investigation, such as where a law enforcement agency may exercise a warrant to inspect ADC’s Internet Service Provider’s (ISP) logs.

Contacting ADC Through the Website

  • If you send a message to ADC through the web contact page, ADC only records or uses the personal information to respond to the request or provide the requested service. Email addresses collected in this way will not be added to a mailing list or used for any other purpose without prior consent. If ADC wishes to use email addresses for another purpose, we will seek prior consent by way of a specific request in writing.

Cookies

  • Cookies are pieces of information that a website can transfer to a visitor’s web browser. Parts of ADC’s website may store cookies on browsers to provide better service on subsequent visits. Web browser settings can be changed to reject cookies or to prompt each time a website wishes to add a cookie to the browser. Some functionality on the website may be affected by this. Security of Personal Information

  • ADC maintains the same level of security for personal information collected electronically as for personal information collected on paper. However, if you are providing personal information via email or an online form, be aware that there are some risks to transmitting data via the Internet.

Links to Other Websites

  • ADC’s website may contain links to other websites. ADC is not responsible for the content and privacy practices of other websites and encourages you to examine each website’s privacy policy and make your own decisions regarding the accuracy, reliability, and correctness of material and information found.

Collection and Maintenance of Personal Information

  • ADC collects personal information only where it is reasonably necessary for, or directly related to, ADC’s functions or activities, or if collecting sensitive information, if the person concerned expressly consents to the collection. ADC will generally collect personal information directly from you when you provide your details to us. ADC may also collect your personal information indirectly through emails, forms, online queries, the use of our website, and telephone conversations. When personal information is received that was not solicited, it is handled as if the information was requested.
  • The types of information that ADC may request include:
    • Email notifications, such as your order status, your web account number, or our technical response to your problem
    • Your acceptance to receive information from a salesperson
    • Confirmation that you will attend an ADC business-related conference or seminar

In the case of newsletters or mailing lists, you can “unsubscribe” from these mailings at any time by emailing the word REMOVE in the subject field, along with your company name and contact details, to admin@ausdatacentre.com.au, and we will remove your details from our database.

Use of Personal Information

  • ADC will only use your information to support your interaction with ADC. ADC staff who access your information under normal business procedures are required to protect your data and privacy in accordance with this Privacy Policy.
  • You have the option of dealing with ADC without revealing your identity. You may remain anonymous or use a pseudonym, unless ADC is required or authorised by law to deal only with an identified person, or it is impracticable for ADC to respond without you being identified, such as to provide you with feedback.
  • If a pseudonym is used, ADC will not link other personal information to the pseudonym unless required or authorised by law, it is impracticable for ADC to act differently, or you have consented to a link. Access to any personal information that may be linked to a pseudonym is restricted to authorised staff.

Disclosure of Personal Information outside of Australia

  • ADC may disclose your personal information to other members of the ADC Entity for business purposes in line with this policy. Otherwise, ADC will not disclose your personal information to overseas recipients unless we are required or authorised by law to do so.

Accuracy and Quality of Personal Information

  • ADC will endeavour to collect and use personal information that is accurate, complete, and up to date. ADC will take reasonable steps to confirm the quality of personal information before it is used or disclosed.

Storage and Security of Personal Information

  • ADC uses a range of physical and electronic systems to store personal information and takes all reasonable steps to secure the information from misuse, interference and loss, unauthorised access, modification, or disclosure. These measures include:
    • Implementing secure storage solutions for both physical and electronic records.
    • Restricting access to personal information to authorized personnel only.
    • Regularly updating and patching security systems to protect against vulnerabilities.
    • Conducting periodic security audits and assessments to ensure ongoing protection.

Access to and Correction of Personal Information

  • You have the right to request access to the personal information ADC holds about you and to seek corrections if you believe the information is inaccurate, incomplete, or outdated. ADC will take reasonable steps to verify your identity before granting access or making corrections and will respond to your request within a reasonable timeframe.

Retention and Disposal of Personal Information

  • ADC retains personal information only for as long as necessary to fulfill the purposes for which it was collected or as required by law. When personal information is no longer needed, ADC ensures its secure disposal through methods such as shredding physical documents or permanently deleting electronic records.
